Terms of Service

These Terms of Service (“Terms”) govern the use of the Oratastic website, platforms, learning materials, and related services (“Services”) provided by Vārdu vārti SIA, a company registered in Latvia (registration No. 40103875142, VAT No. LV40103875142), located at Avotu iela 33–13, Rīga, LV-1009, Latvia (“Vārdu vārti”, “we”, “our”, “us”).

Oratastic is a trading name of Vārdu vārti SIA. By creating an account or using any part of our Services, you (“Client”, “you”, “your”) agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

1.1. You must be at least 16 years old to register and use Oratastic. 1.2. By registering, you represent that the information you provide is accurate and that you are legally permitted to use the Services under your local laws.

2. Refunds for Individual Monthly Subscriptions

2.1. To access free materials, paid courses, or personalised learning features, you must create an account. 2.2. Upon registration you must provide your full name and email address. 2.3. You are responsible for maintaining the confidentiality of your login credentials. 2.4. Account sharing is strictly prohibited.

3. Device Limit

3.1. Each Client may use their account on a maximum of two (2) devices. 3.2. Attempts to exceed this limit, including repeated attempts to add additional devices, may result in suspension or termination (see Section 15).

4. Services Offered

4.1. Oratastic provides:

• Free language learning materials;
• Paid language learning courses delivered on a subscription basis;
• Company-based access via voucher activation.

4.2. We may introduce new features, modify existing content, or discontinue certain parts of the Services at any time.

5. No Guarantee of Learning Outcomes

5.1. Language acquisition depends on individual effort, circumstances, and previous knowledge. 5.2. Vārdu vārti SIA does not warrant, promise, or guarantee that you will achieve a particular level of language proficiency, score, fluency, or any other measurable outcome. 5.3. You acknowledge that your progress is your own responsibility.

6. Subscription Payments (Individual Clients)

6.1. Individual Clients may subscribe to paid courses using monthly automatic payments processed by Stripe. 6.2. Charges recur automatically each month until you cancel the subscription. 6.3. Cancellation takes effect at the end of the current billing period; no pro-rated refunds are provided unless required by law or stated in our Refund & Cancellation Policy. 6.4. You must ensure that your payment details remain valid and up to date.

7. Company Agreements and Vouchers

7.1. Companies may purchase access for multiple learners under a direct contract with Vārdu vārti SIA. 7.2. Following payment, Vārdu vārti issues individual vouchers which learners must activate using their personal accounts. 7.3. Access duration for each learner begins upon voucher activation. 7.4. Vouchers must be activated within 12 months from their date of issuance, after which they may expire. 7.5. Refund rules for company agreements are detailed in our Refund & Cancellation Policy.

8. Free Materials

8.1. Certain content on Oratastic is offered free of charge. 8.2. Free content does not imply any right to continued access; we may remove or modify it at our discretion.

9. Personalisation and Profiling

9.1. Oratastic may use personalisation features including:

• Recommendations based on your progress and behaviour;
• Automated profiling to tailor difficulty levels, pathways, or learning suggestions;
• Targeted marketing communications (with your consent).

9.2. Details regarding personalisation, your rights, and withdrawal of consent are provided in our Privacy Policy.

10. Acceptable Use

10.1. You must not:

• Share your account with others;
• Attempt to circumvent the two-device limit;
• Copy, redistribute, resell, publish, or otherwise exploit any materials without express written permission;
• Attempt to reverse-engineer, extract, scrape, or replicate any part of the website or its content;
• Engage in behaviour that is abusive, harassing, or inappropriate towards staff or other users.

10.2. You may use the Services solely for personal, non-commercial learning purposes unless otherwise agreed in writing.

11. Intellectual Property

11.1. All course materials, content, text, graphics, videos, algorithms, and software made available through Oratastic are the property of Vārdu vārti SIA or its licensors. 11.2. No rights or licences are granted to you except for the limited right to use the Services in accordance with these Terms. 11.3. Unauthorised reproduction, redistribution, publication, resale, scraping, or reverse-engineering of the materials is strictly prohibited and may result in legal action.

12. Availability and Technical Issues

12.1. While Vārdu vārti aims to ensure stable availability, we cannot guarantee that the Services will be uninterrupted, error-free, or free from delays. 12.2. Temporary downtime may occur during maintenance or technical failures.

13. Third-Party Services

13.1. Payments are processed via Stripe. Stripe operates under its own terms and privacy practices. 13.2. We may use analytics tools (e.g., Google Analytics) and hosting providers such as Cloudways. 13.3. Use of third-party services is governed by their respective terms.

14. Termination of Account

14.1. Vārdu vārti may suspend or terminate your account if:

• You share your account or attempt to exceed the device limit;
• You attempt to reverse-engineer or misuse the Services;
• You engage in prohibited conduct including redistribution of materials;
• You behave in a persistently rude or inappropriate manner toward staff or users;
• Required payments fail or remain unpaid.

14.2. You may delete your account at any time. 14.3. Termination does not entitle you to refunds except where required by law or outlined in our Refund & Cancellation Policy.

15. Limitation of Liability

15.1. To the maximum extent permitted by law, Vārdu vārti SIA is not liable for:

• Any indirect, incidental, or consequential losses;
• Loss of profits, data, or business opportunities;
• Failures in internet connectivity or user devices;
• Outcomes of language learning or lack of progress.

15.2. Nothing in these Terms limits liability where such limitation is prohibited by law.

16. Right of Withdrawal (EU Consumers)

16.1. EU Clients have a 14-day right of withdrawal for digital content purchases. 16.2. By activating access to a paid course before the end of the withdrawal period, you agree that Vārdu vārti may begin providing the service and that you may lose part or all of your withdrawal rights. 16.3. 17. Governing Law and Dispute Resolution

17.1. These Terms are governed by the laws of Latvia. 17.2. In the event of a dispute, the parties should first attempt an amicable resolution. 17.3. As required by EU law, consumers may use the European Commission’s Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr 17.4. Latvian courts have exclusive jurisdiction over disputes unless otherwise required by consumer protection law.

18. Changes to These Terms

18.1. Vārdu vārti may update these Terms from time to time. 18.2. Significant changes will be communicated via email or through the platform. 18.3. Continued use of the Services constitutes acceptance of the updated Terms.
