Refund & Cancellation Policy
This Refund & Cancellation Policy explains when Clients may receive refunds for purchases made on the Oratastic platform, operated by Vārdu vārti SIA (“we”, “our”, “us”).
It applies to:
- Individual Clients using monthly subscription payments via Stripe
- Company agreements involving vouchers issued to multiple learners
This Policy forms part of the Terms of Service.
1. Definitions
- Client – an individual user of Oratastic.
- Company Client – a legal entity purchasing access for multiple learners.
- Voucher – an access code issued to a learner under a Company Agreement.
- Billing Period – one month for subscription payments.
- Right of Withdrawal – EU consumer right to cancel within 14 days for digital content.
2. Refunds for Individual Monthly Subscriptions
2.1. Subscription billing
Subscriptions are billed automatically on a monthly basis through Stripe until cancelled by the Client.
2.2. Cancellation of subscription
Clients may cancel their subscription at any time via their account settings. Cancellation becomes effective at the end of the current billing period.
2.3. No pro-rated refunds
We do not offer refunds for unused portions of a billing period, unless required by law or stated otherwise in this Policy.
3. EU Right of Withdrawal (Individual Clients)
We process personal data under the following GDPR legal bases:
3.1. Withdrawal period
Individual Clients residing in the EU or EEA have a 14-day right of withdrawal from the date of purchase.
3.2. Early access to digital content
By activating or accessing the paid course before the end of the 14-day period, you request immediate performance of the service. You acknowledge that: you may lose your right of withdrawal, or if you withdraw within 14 days after access has begun, you may receive a partial refund reflecting the proportion of the service provided up to the moment of withdrawal.
3.3. How to exercise the right of withdrawal
Clients may contact us at info@oratastic.eu with a clear statement of cancellation. We will process the withdrawal within the timelines required by EU consumer law.
4. Additional Goodwill Refunds (Individual Clients)
4.1. Beyond legal requirements, Oratastic may issue refunds as a gesture of goodwill in certain situations, including:
- if the Client unintentionally remained subscribed and was charged for a period they did not intend to use;
- if there are significant technical issues preventing access to the course, where the issue is not caused by the Client’s device or connection;
- other reasonable circumstances assessed on a case-by-case basis.
4.2. Goodwill refunds are discretionary and not guaranteed.
5. Non-Refundable Situations (Individual Clients)
Refunds will generally not be issued if:
- a Client has fully used the Service during the period in question;
- the Client failed to cancel before the next billing cycle;
- access has been removed due to violation of the Terms of Service;
- the request concerns payments older than a reasonable period (normally beyond 3 months), unless otherwise required by law.
6. Refunds and Cancellations for Company Agreements
6.1. Nature of Company Agreements
Company Clients purchase access for multiple learners through direct contracts and receive a set number of vouchers.
6.2. Activation rules
Access for each learner begins on the date of voucher activation, not on the date of purchase. Vouchers must be activated within 12 months of issuance unless otherwise agreed.
6.3. Refund exclusions (Company Clients)
Under standard Company Agreements:
- Payments are non-refundable once the contract is concluded.
- There are no refunds for unused, partially used, unactivated, or expired vouchers.
- Partially completed courses by learners are not eligible for refunds.
6.4. Replacement of faulty vouchers
If a voucher fails due to technical error caused by Oratastic systems, we will issue a replacement free of charge.
7. Termination and Access After Cancellation
7.1. Individual Clients retain access to paid content until the end of the paid Billing Period. 7.2. Learners under Company Agreements retain access for the duration assigned to their voucher, unless terminated for violation of the Terms of Service. 7.3. No refunds are provided where termination is due to misuse or breach of the Terms.
8. How Refunds Are Processed
8.1. Individual subscription refunds are processed through Stripe to the original payment method. 8.2. Company Agreement refunds (in rare cases where required by law) are processed through bank transfer.
8.3. Refund processing may take up to:
- 7–14 days for Stripe-processed refunds;
- 7–21 days for bank transfer refunds.
